Pooled Special Needs Trusts are an essential, but often misunderstood, planning tool for clients with disabilities who rely on means-tested public benefits. This Lunch & Learn will provide a practical, practitioner-focused overview of pooled trusts and their role in both proactive and crisis planning.
The program will address how pooled special needs trusts function under federal law and Maryland practice, including eligibility requirements, sub-account structure, and the distinction between first-party and third-party pooled trusts. Particular attention will be given to when a pooled trust is preferable to an individually drafted SNT, including timing, cost, family dynamics, and administrative considerations.
The discussion will also cover Maryland-specific issues practitioners encounter, including Medicaid payback requirements, interaction with SSI and Medicaid eligibility, and common drafting and funding mistakes that create compliance or administration problems.
